PMAN VS DELE ABIODUN
FACT NO. 1
Fact 1
Admiral Dele Abiodun was the Vice President of PMAN during Charly Boy’s regime. They were both elected in October of 2004 to
serve as President and Vice President respectively for 2yrs at PMAN National Delegate Conference (NDC) held in Enugu State.
FACT NO. 2
On 21st Nov. 2005, Dele Abiodun was accused of anti-union activities and was subsequently suspended for 8 months during a PMAN
National Executive Council meeting held at the PMAN National Secretariat situated at 18 Adegbola Street, Ikeja, Lagos. Dele Abiodun
was in attendance in that meeting. His suspension was in accordance with Rule 9, Clause 18 of PMAN Constitution. He never appealed
his suspension nor did he seek any other constitutional means of redress or objection to his fate if he felt aggrieved in any way.
FACT NO. 3
Since Dele Abiodun never appealed against the said suspension to date and having been so suspended, Dele Abiodun was subject to
Rule 14, Clause 6 of PMAN Constitution which states inter alia “A suspended member shall have no membership rights or privileges
during the period of his or her suspension” This means loss of right to vote and be voted for. Dele Abiodun’s purported Uyo election
therefore was for all intents and purposes, a rouse, illegal and void, ab initio.
FACT NO. 4
PMAN’s NDC (National Election) was held at Enugu in the Month of October 2004 but due to Tony Okoroji’s incursion and attempt to
usurp the presidency of PMAN, swearing in of Charly Boy and Dele Abiodun as President and Vice President respectively for their
two year tenure was now delayed till Nov. 21st 2004. Please note: as in Peter Obi’s case, their 2yrs tenure starts counting from when
they were sworn in. Charly Boy never over stayed his tenure for one single day as has been alleged by Dele Abiodun.
FACT NO. 5
Due to his recalcitrance and unrepentance and for going to Uyo to “elect” himself as “President” of PMAN while on suspension, the
said Dele Abiodun’s suspension was later upgraded to expulsion at the 2006 Kaduna PMAN National Delegate Conference which
ushered in the Bolaji Rosiji and Engr. George Dureke’s team. All 28 state chapters of PMAN participated in that conference (election).
FACT NO. 6
As a result of his illegal Uyo election, PMAN sued Dele Abiodun to court to stop him from parading himself as the President of PMAN.
That matter is subsisting and the hearing proper has not even started. In the process of the suit, PMAN filed a motion praying the
court to disqualify Fred Agbaje, Esq. from representing Dele Abiodun since the same Agbaje Esq. was once a legal adviser to PMAN at
one stage. PMAN’s position was that Fred Agbaje, Esq. has privileged information that he can use unfairly against PMAN in the case.
FACT NO. 7
The Hon. Justice Marsh however ruled that he does not see what PMAN could lose from the continued defense of Dele Abiodun in the
case by Fred Agbaje, Esq and asked both parties to proceed with their case. Justice Marsh made it clear that he is limiting his ruling
within the confines of PMAN’s prayers; please note that courts do not grant a prayer that is not asked for in a motion. More so, a
ruling in the course of a substantive case praying for the disqualification of a defense lawyer cannot translate to a judgement, suffice to
say that PMAN has appealed this ruling and the appeal is pending with a due date in January 2008!
FACT NO. 8
The Bolaji Rosij - Engr. George Dureke led executive were elected at the Kaduna PMAN National Delegate Conference on 20th Feb
2006. However, Bolaji Rosiji resigned in Jan 2007 out of his own volition. The Vice President of PMAN, Engr. George Dureke selflessly
decided to sacrifice his right to ascend to become the President of PMAN. His decision was based on his quest to have a broad based
governance in PMAN and to use the God given opportunity to reunite the house of PMAN. He called for a PMAN National Executive
Council (NEC) meeting to fill the vacant post of President of PMAN in accordance with Rule 13, Clause 4 of the PMAN Constitution.
FACT NO. 9
The biggest PMAN NEC ever was held in Warri, Delta State on 2nd May 2007. It was at that meeting that Engr. George Dureke presented
Tee Mac Omatshola Iseli to the members of NEC comprising of PMAN Governors and their Secretaries from 28 State Chapters and Zones
of PMAN. Gladly, without any single objection, TEE MAC OMATSHOLA ISELI was ratified as the President till the next National Delegate
Conference of PMAN in 2009 which would have been the end of Bolaji Rosiji’s tenure.
FACT NO. 10
It may interest you to note that irrespective of untold provocations and antics of Dele Abiodun, the President of PMAN, veteran flutist,
TEE MAC OMATSHOLA ISELI has remained steadfast and has never made any statement that may misled the general public, instead
Tee Mac has continued to court Dele Abiodun’s understanding of the whole situation and has prevailed on him to accept his fate like a
man and desist from causing further disaffection in the Union. The vast majority of members of PMAN would like to use this opportunity
to thank the general public for their understanding. PMAN is still one united Musicians Union with a few dissenting voices. It’s natural. |
